1. Scope of application
ROYAL CHAMPAGNE operates the ROYAL CHAMPAGNE HOTEL ET SPA hotel based in CHAMPILLON (51160) with 47 rooms (44-110 m2) , two restaurants, a bar, a spa, two swimming pools and numerous reception areas.
These General Terms and Conditions of Sale (the "GTCS") apply without restriction or reservation to all hotel services (the "Services") provided by ROYAL CHAMPAGNE to clients acting for their personal needs ("the Clients") to the exclusion of any other document. The Client declares that he/she has read these General Terms and Conditions of Sale and has accepted them prior to booking. These General Terms and Conditions of Sale may be subject to subsequent modifications, and the version applicable to the Client's reservation is that in force on the date of the reservation.
2. The ROYAL CHAMPAGNE offer
The main characteristics of the Services and in particular the specifications relating to the rooms are presented by ROYAL CHAMPAGNE in its brochures and on its website (www.royalchampagne.com).
All the information required to book the Services is presented in French and English.
The Client chooses the Services he/she wishes to book. It is the Client's responsibility to inform ROYAL CHAMPAGNE immediately of any aspect that needs to be taken into account in order to best meet their needs (pets, allergies, disabilities, etc.). It is the Client's responsibility to refer to the description of each Service in order to be aware of its essential characteristics and to ask ROYAL CHAMPAGNE any specific questions.
Offers are valid under the conditions specified on the Website.
3. Booking
The Customer chooses the Services he/she wishes to book on the ROYAL CHAMPAGNE website or by contacting ROYAL CHAMPAGNE directly by telephone or email.
For group bookings or bookings on behalf of professionals, please contact ROYAL CHAMPAGNE directly.
Reservations are limited to a maximum of 6 rooms.
3.1 Booking by telephone or email
If the reservation is made by telephone or email, ROYAL CHAMPAGNE will send a confirmation email to the Client reminding them of :
- the booking dates,
- the number of nights,
- the essential details of the room(s) booked,
- the price,
- tourist taxes,
- any optional extras (breakfast, etc.)
- the reservation number.
For all reservations, the Customer will be asked for his/her bank card number (and expiry date) as a guarantee. The credit card will not be debited and payment for the stay will be made directly on site on the day of arrival or departure, unless the Customer does not turn up and has not previously cancelled the booking in accordance with the cancellation conditions in article 5.
3.2 Online reservations on the Royal CHAMPAGNE website
Online bookings are made on the ROYAL CHAMPAGNE website according to the process presented on the website.
To book on the website, it is the Client's responsibility to select on the website the Services they wish to book, according to the following procedures:
- Select the Service and add it to the basket.
- Fill in the order form. In the event of prolonged inactivity during connection, it is possible that the selection of the Services chosen by the Customer before this inactivity will no longer be guaranteed. In this case, the Customer is invited to restart his or her selection of Services from the beginning.
- Check the details of the Booking and, if necessary, identify and correct any errors.
- Validate the Order, the Total Price per Service and the total, then click on the "Book and Pay" tab, which will form the contract. This validation implies acceptance of these GTC in their entirety and constitutes proof of the contract.
- The Customer must then enter the personal information required for each booking. This includes: email address, surname, first name and, optionally, telephone number.
- Follow the payment instructions to guarantee their booking (bank transfer).
Up until the validation stage, the Customer will be able to return to the previous pages to correct or modify their order and the information previously provided.
The contract will not be considered definitive until confirmation of acceptance of the booking has been sent to the Customer by email.
The Customer will immediately receive an electronic acknowledgement of receipt containing the essential information about the booking, which will serve as confirmation of the booking.
3.3 Online bookings on other websites
Reservations can also be made on partner sites: Booking, Expedia, Mr & Mrs Smith, Leading Hotel of the World. In this case, the General Terms and Conditions of Sale apply to reservations in addition to any specific provisions that may also be provided by these partners.
3.4 Guaranteed booking
This service does not incur any charges as long as any cancellation is made in accordance with the conditions set out in article 5.3.
ROYAL CHAMPAGNE undertakes to reserve and make available to the Customer the Services until the rooms are vacated (midday) on the day following the Customer's arrival date.
In this case, if the Customer has not arrived by the time the room is vacated on the day following the scheduled arrival date, the provisions of article 5.3 will apply.
3.5 Deposit - Stay of 4 nights or more
Notwithstanding the preceding articles, a payment of 50% of the total amount of the stay is required for all bookings of :
- a Marie-Louise or Joséphine Suite ;
- or a stay of more than 4 nights.
Payment is made by the Customer at the time of booking.
In the event that ROYAL CHAMPAGNE has to cancel the reservation, the client-consumer is entitled to compensation equal to double the deposit paid.
3.6 Refusal of a reservation
In accordance with the provisions of article L.122-1 of the French Consumer Code, ROYAL CHAMPAGNE reserves the right to refuse any reservation made by a Client in the event of non- payment, late payment, partial payment, rejection of the means of payment or opposition to payment by the bank holding the account, but also in the event of a previous dispute relating to the payment of a previous reservation or in the event of an abnormal reservation made in bad faith. In this case, ROYAL CHAMPAGNE will inform the Client.
3.7 Unavailability
Exceptionally, if a reserved room is unavailable (due to an exceptional event or force majeure), ROYAL CHAMPAGNE reserves the right to accommodate the Client in a hotel in the region in an equivalent category for the duration of the reserved stay.
Subject to the Client's agreement, ROYAL CHAMPAGNE will only pay for any additional costs (additional cost of the room, transport between the two establishments).
4. Bank pre-authorisation as a guarantee
To activate a request for pre-authorisation, the Customer is asked to provide their bank card details. The Customer is informed in advance of the characteristics of the pre-authorisation request. The bank card details are kept by the payment service provider as part of a strict bank data security policy. If the Customer's bank refuses to give pre-authorisation, the reservation cannot be guaranteed.
This pre-authorisation from the Customer's bank corresponds to the amount of the reservation plus a flat-rate amount of 500 euros per night reserved, intended to cover expenses incurred on site and not included in the price (such as minibar consumption or tourist tax), and any proven damage to the room caused by the Customer.
This sum is reserved on the account of the Customer holding the bank card. The bank pre- authorisation is not debited, only the funds are blocked. Depending on the banking establishment, the pre-authorisation request may temporarily reduce the limit on the bank card used by the Customer to guarantee the possible future debit, or appear as a pending debit.
At the end of the stay and payment of the reservation, ROYAL CHAMPAGNE cancels the pre- authorisation with the Customer's bank, except in special cases. The cancellation usually takes twenty-four (24) to forty-eight (48) hours to be taken into account, but this may take up to seven (7) working days or more, depending on the Client's bank.
"No Show: If the Customer does not show up at on the day of their Reservation, the latter is considered to be cancelled and the cancellation conditions set out in article 5.3 apply, allowing the cancellation fees to be retained.
5. Modification - Cancellation of the Reservation
5.1 No right of withdrawal
The Customer is reminded that, in application of the provisions of article L.221-28 of the French Consumer Code, he/she does not have the right of withdrawal in the case of a reservation of hotel services.
5.2 Changing the booking
The Customer who wishes to modify his/her reservation must inform ROYAL CHAMPAGNE as soon as possible (by telephone, email or via the reservation platform). ROYAL CHAMPAGNE will do its utmost to satisfy the Customer's request but cannot guarantee that the requested modifications will be carried out.
5.3 Cancellation of the reservation
No fee will be charged if the cancellation or modification has been made under the conditions below (except in the specific cases set out in article 3.5 of the GTCS).
Please note that cancellation conditions vary according to the season during which the Services are scheduled.
The seasons are defined as follows:
- High season: from 1stApril to 31 October inclusive;
- Low season: from 1stNovember to 31 March inclusive.
High season: Reservations must be cancelled before 4pm (French time), 3 days before the scheduled arrival date.
Low season: Reservations must be cancelled before 4pm (French time), 1 day before the scheduled arrival date.
5.4 Interruption of stay
If the stay is interrupted, the night following the date of interruption will be charged.
ROYAL CHAMPAGNE reserves the right to offer stays with a minimum number of nights. In this case, the entire stay will be due and no refund will be made.
6. Prices
The prices of Services are those applicable at the time of booking, as shown on the website or on the offer given to the Customer, and are displayed in euros, inclusive of all taxes.
The prices issued are determined by a practice of fine-tuned price management. They may therefore depend on several parameters such as (non-exhaustive list): the reservation date, the date of stay, the period between these two dates, etc.
Prices are indicated per room for the selected dates of stay (services included). The applicable tourist tax is indicated on the booking form, online and in the booking confirmation sent by email.
Prices are payable in euros.
Unless otherwise stated, ancillary services are not included in the price of the room.
Clients are jointly and severally liable for payment of the price. In this respect, ROYAL CHAMPAGNE may demand payment of the price from each of the joint and several debtors for the entire price.
7. Terms of payment for reservations
7.1 Terms and conditions of payment
Payment will be made at the end of the stay.
For bookings made in application of article 3.5, the deposit paid by the Customer at the time of booking will be deducted from the sums to be paid at the end of the stay.
ROYAL CHAMPAGNE nevertheless reserves the right to ask the Customer, upon arrival, for a deposit or authorisation to debit the credit card, in order to guarantee payment of the sums due to ROYAL CHAMPAGNE.
Payment by cheque is not accepted.
Cash payment is limited to 1,000 euros for French tax residents and 15,000 euros for customers whose tax residence is not in France.
7.2 Guaranteed reservation system
In addition, for guaranteed reservation services, the Customer must give his/her card number, the month and year of expiry shown on the card and the security code shown on the back of the card by telephone or email.
The Customer declares and certifies that he/she is the holder of the bank card used to pay for the Services.
The Customer guarantees that the information provided to ROYAL CHAMPAGNE is accurate and up to date and undertakes to inform ROYAL CHAMPAGNE of any changes that may occur.
An email will be sent to the Client after the reservation has been made including a reservation number.
By accepting these GTS, the Client expressly authorises ROYAL CHAMPAGNE to automatically deduct the price of any Services due (including cancellation fees).
The Client's bank details are encrypted and ROYAL CHAMPAGNE will cancel the Client's pre- authorisation as soon as payment for all Services due has been definitively made.
The payment order (including the bank imprint) made electronically cannot be cancelled. Payment of the booking by the Customer is therefore irrevocable, without prejudice to the Customer's right to cancel the booking at a later date.
8. Withdrawal
In accordance with article L 221-28 of the French Consumer Code, the Customer has no right of withdrawal for accommodation and catering services.
9. Hotel stay
9.1 Administrative information
ROYAL CHAMPAGNE may transcribe the information provided by the Client at the time of booking onto the police form, so that the Client only has to sign the said police form on arrival at the establishment. In this case, the Customer will be asked to show proof of identity to check whether a police form needs to be completed.
9.2 Customer welfare - Regulations
Minors must be accompanied by a duly authorised adult. ROYAL CHAMPAGNE reserves the right to request any justification.
Customers must take all necessary precautions when moving their animals around the establishment.
The Client undertakes to use the room in compliance with the law, the principles of safety/hygiene, public decency and public order. Failing this, ROYAL CHAMPAGNE may ask the Customer to leave the establishment without any compensation or reimbursement.
The Client undertakes to ensure that the computer system (Wifi) made available by the establishment is not used for the purpose of reproducing, representing, making available or communicating to the public works protected by copyright or related rights. More generally, the Customer agrees not to consult, download and/or publish via the Wifi made available by the ROYAL CHAMPAGNE, any message, information, file, image and/or document that is :
- Contrary to human dignity, racist, negationist, defamatory, rude or insulting,
- Contrary to public order and morality and/or constituting an incitement to paedophilia,
- Contrary to the right to respect for the private life of others,
- Contrary to any legislative or regulatory provision in force,
When using the Wifi made available by ROYAL CHAMPAGNE, the Customer also undertakes to refrain from :
- masking their true identity ;
- usurp the identity of others;
- destroying, altering, modifying data or accessing information belonging to third parties without their authorisation;
- interrupt or disrupt the normal operation of the computer system (Wifi) provided by ROYAL CHAMPAGNE;
- introduce any form of computer virus, intentionally or unintentionally;
- engage in hacking activities.
The Customer undertakes to leave his/her room by midday.
10. Liability
ROYAL CHAMPAGNE may not be held liable for any prejudice not directly related to the Services or for any prejudice caused by a third party.
ROYAL CHAMPAGNE cannot be held responsible for the non-execution or poor execution of the reservation in the event of force majeure, the act of a third party, unforeseeable and insurmountable, the act of the customer, in particular the unavailability of the internet network, impossibility of access to the website, external intrusion, computer viruses or in the event of unauthorised payment by the Customer's bank.
Any deterioration of the rooms or space made available to the Customer will give rise to compensation from ROYAL CHAMPAGNE by the Customer.
The photographs presented on the Website are not contractual, as variations may occur between the photographs and the decoration or after work has been carried out.
ROYAL CHAMPAGNE accepts no responsibility for the content and services offered by these sites.
In any event, ROYAL CHAMPAGNE cannot be held responsible for theft or damage to items left in the hotel due to force majeure, nor for loss resulting from the nature or defect of the item or from the Customer's actions.
11. Complaints
Complaints must be sent to ROYAL CHAMPAGNE by e-mail - [email protected], by post - 9 rue de la République, 51160 Champillon or by telephone (0326528711). Complaints made by telephone must be accompanied by an email or letter so that the complaint can be dealt with within 15 days of leaving the establishment.
12. Intellectual property rights
All documents, products, drawings, photographs presented and/or given to the Customer are and remain the exclusive property of ROYAL CHAMPAGNE, the sole owner of the intellectual property rights on these documents, which must be returned to the Customer upon request.
The Client undertakes not to make any use of these documents, and more generally to refrain from any behaviour likely to infringe ROYAL CHAMPAGNE's intellectual property rights.
13. Personal data
Pursuant to Law 78-17 of 6 January 1978 (Loi Informatique et Libertés) and the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation), the Customer is informed that personal data concerning him/her will be requested. This data is necessary to enable ROYAL CHAMPAGNE to process their requests and reservations, and to enable ROYAL CHAMPAGNE to provide the Customer with hotel services in compliance with applicable regulations. If this data is not provided, ROYAL CHAMPAGNE will not be able to process the Customer's requests and reservations, nor provide the requested Services.
This data is mainly intended for ROYAL CHAMPAGNE. The Customer is nevertheless informed that this data may also be communicated to any partners of ROYAL CHAMPAGNE in order, where applicable, to offer the Customer the benefit of the services proposed by these partners.
This data is kept for a period that varies according to its nature and its usefulness in relation to the aforementioned purposes. The data concerned is then deleted, anonymised or archived, as appropriate.
The Customer is also informed that the buildings of the ROYAL CHAMPAGNE, excluding the rooms, are placed under video surveillance for the purposes of security of goods and premises. The images recorded by the cameras may be viewed by ROYAL CHAMPAGNE's security manager and, where applicable, the police and/or gendarmerie. They are deleted 30 days after recording.
In accordance with national and European regulations in force, the Customer has the right to access, rectify and oppose, limit the processing of data concerning him/her, port this data, and request its deletion, under the conditions and within the limits defined by the applicable regulations, and in particular the French Data Protection Act and the General Data Protection Regulations. For any processing for which the Customer has consented to the processing of his/her personal data for one or more specific purposes, the Customer is informed that he/she has the right to withdraw his/her consent at any time, without affecting the lawfulness of the processing based on the consent given prior to the withdrawal of consent.
To exercise these rights, the Customer may contact ROYAL CHAMPAGNE
Finally, the Customer is informed that he/she also has the right to lodge a complaint with the Commission Nationale de l'Informatique et des Libertés.
14. Force majeure
In the event of a force majeure event, i.e. any event beyond the control of the Parties, such as war, acts of war, boycotts, strikes, natural disasters, blockage of means of transport, floods, storms, explosions, fire, interruption of electronic means of communication, shortage of raw materials, etc., delivery may be suspended until the event in question ceases, for a period not exceeding one month. In the event of suspension for more than one month, the contract may be cancelled ipso jure, subject to either party giving 7 days' notice by registered letter with acknowledgement of receipt.
15. Canvassing by telephone
In accordance with the provisions of article L.223-2 of the French Consumer Code, if the Customer does not wish to be approached for commercial purposes by telephone, the Customer may register free of charge on a list of people opposed to telephone canvassing known as Bloctel, which can be accessed at the following address: www.bloctel.gouv.fr.
16. Miscellaneous
In the event that any provision of these GTC is declared null and void or deemed unwritten, all other provisions shall continue to apply. ROYAL CHAMPAGNE's failure to invoke any of these GTS may not be interpreted as a waiver of its right to invoke them at a later date.
Entering the required bank details, as well as accepting these GTC and the booking request, constitutes acceptance of the hotel contract between the parties, which has the same value as a handwritten signature. The registers are kept in the ROYAL CHAMPAGNE's computer system and stored in reasonable security conditions. They are considered as proof of communications, reservations and payments between the parties.
This right may be exercised under the conditions and according to the procedures defined in the Terms of use section of the Website.
17. Applicable law - Dispute
These General Terms and Conditions of Sale and the operations arising from them are governed by and subject to French law.
In the event of a dispute, the Customer shall first contact the Seller to find an amicable solution.
The Customer is hereby informed that he/she may in any event have recourse to conventional mediation, in particular with the Commission de la médiation de la consommation ( art. L 534-7 of the French Consumer Code) or with existing sectoral mediation bodies such as MTV Médiation Tourisme Voyage (BP 80 30375 823 Paris Cedex 17) or to any alternative dispute resolution method (conciliation, for example) in the event of a dispute.
Failing this, the competent courts are the French courts in application of the rules of the Code of Civil Procedure.
The language of the contract is French. In the event of a translation of these GCS into foreign languages, only the French version shall be deemed authentic.
18. Pre-contractual information
The Customer acknowledges that, prior to booking, he/she has been provided, in a legible and comprehensible manner, with the present CGV and with all the information and details referred to in articles L111-1 to L111-7 of the French Consumer Code, and in particular:
- the essential characteristics of the Services;
- the price of the Services and ancillary costs (taxes, etc.);
- information relating to the ROYAL CHAMPAGNE establishment (full contact details, hotel activity),
- the possibility of resorting to conventional mediation in the event of a dispute;
- information relating to the absence of a right of withdrawal and other important contractual conditions .
The fact that a person books Services implies full and unreserved adherence to and acceptance of these GCS, which is expressly recognised by the Customer.
